1. INTRODUCTION

GoGaadi Logistics India ("GoGaadi Logistics") operates a technology platform that connects users ("Customer", "Sender", "Consignor") with independent third-party driver partners for transportation of goods.

By accessing or using the GoGaadi logistics application ("Platform"), you agree to be bound by these Terms and Conditions.

2. NATURE OF SERVICE

GoGaadi Logistics is strictly a technology intermediary platform.

GoGaadi Logistics does NOT:

  • Own or operate vehicles
  • Employ drivers
  • Provide transportation services directly

All transportation services are provided by independent driver partners.

3. ACCEPTANCE OF TERMS

By using the Platform, you:

  • Confirm that you have read and understood these Terms
  • Agree to be legally bound
  • Accept all future updates to these Terms

4. USER RESPONSIBILITIES

You agree to:

  • Provide accurate pickup and delivery details
  • Ensure proper packaging of goods
  • Ensure goods are legal and safe for transport
  • Provide correct description and value of goods

You are solely responsible for the goods being transported.

5. INDEPENDENT DRIVER DISCLAIMER

Driver partners are independent contractors.

GoGaadi logistics is NOT responsible for:

  • Driver behavior or misconduct
  • Theft, absconding, or fraud by driver
  • Damage or loss of goods
  • Delays in delivery

6. GOODS AT OWNER RISK

All goods are transported entirely at the user's own risk.

GoGaadi logistics does not:

  • Take custody of goods
  • Guarantee safety or protection
  • Provide insurance

Users are strongly advised to arrange insurance for valuable goods.

7. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

GoGaadi logistics shall have ZERO liability for:

  • Loss of goods
  • Damage to goods
  • Theft or absconding by driver
  • Delivery delays

In case any liability is imposed by law, it shall be strictly limited to: The service fee paid by the user only.

GoGaadi logistics shall not be liable for:

  • Indirect losses
  • Business losses
  • Loss of profit

8. NO COMPENSATION POLICY

User expressly agrees that:

GoGaadi logistics will NOT provide:

  • Compensation
  • Refunds
  • Replacement

for: Lost goods, Damaged goods, or Theft incidents.

All risks are borne entirely by the user.

9. MISDECLARATION OF GOODS

User must provide correct information.

If misdeclaration occurs:

  • GoGaadi logistics is not liable
  • User must bear all damages
  • User must indemnify GoGaadi logistics

GoGaadi logistics has no obligation to verify contents.

10. RESTRICTED ITEMS

Users must NOT transport:

  • Illegal goods
  • Explosives or weapons
  • Firearms or ammunition
  • Drugs or narcotics
  • Hazardous or flammable materials
  • Currency, jewellery, precious items
  • Alcohol, cigarettes, or restricted substances

Violation may result in:

  • Immediate account suspension
  • Legal action
  • Reporting to authorities

11. DELIVERY TIME DISCLAIMER

All delivery times are estimates only.

GoGaadi logistics is not responsible for delays caused by:

  • Traffic conditions
  • Weather
  • Vehicle issues
  • Government restrictions
  • Driver availability

12. CLAIMS POLICY

All claims must be reported within 24 hours of delivery.

Claims must include:

  • Photos of damage
  • Order details

No claims will be accepted after 24 hours.

13. PAYMENTS

  • Prices are dynamic and may vary
  • Final price may change based on distance, time, or waiting
  • Payments may be made via cash or online methods

Failure to pay may result in:

  • Account suspension
  • Legal recovery action

14. CANCELLATION POLICY

  • Cancellation charges may apply after driver assignment
  • No refund for misuse or late cancellation

15. FORCE MAJEURE

GoGaadi logistics shall not be liable for failure or delay due to:

  • Natural disasters
  • Accidents
  • Government restrictions
  • Strikes or disruptions
  • Any event beyond control

16. INDEMNITY

User agrees to indemnify and protect GoGaadi logistics from:

  • Legal claims
  • Damages
  • Losses caused due to misuse
  • Violation of laws

17. ACCOUNT SUSPENSION

GoGaadi logistics reserves the right to suspend or terminate accounts for:

  • Fraudulent activity
  • Illegal use
  • Violation of Terms

GoGaadi logistics may use third-party providers. GoGaadi logistics is not responsible for:

  • Third-party services
  • Payment gateway failures

19. NO GUARANTEE OF SERVICE

GoGaadi logistics does not guarantee:

  • Availability of drivers
  • Timely delivery
  • Service quality

These Terms are governed by the laws of India.
